Tafsir Ibn Kathir - Fight
them until they pay the
jizya

Paying Jizyah is
a Sign of Kufr and
Disgrace
Allah said,
[حَتَّى يُعْطُواْ
الْجِزْيَةَ]
(until they pay the
Jizyah), if they do not
choose to embrace Islam,
[عَن يَدٍ]
(with willing
submission), in defeat
and subservience,
[وَهُمْ صَـغِرُونَ]
(and feel themselves
subdued.), disgraced,
humiliated and
belittled. Therefore,
Muslims are not allowed
to honor the people of
Dhimmah or elevate them
above Muslims, for they
are miserable, disgraced
and humiliated. Muslim
recorded from Abu
Hurayrah that the
Prophet said,
(Do not initiate the
Salam to the Jews and
Christians, and if you
meet any of them in a
road, force them to its
narrowest alley.) This
is why the Leader of the
faithful `Umar bin
Al-Khattab, may Allah be
pleased with him,
demanded his well-known
conditions be met by the
Christians, these
conditions that ensured
their continued
humiliation, degradation
and disgrace. The
scholars of Hadith
narrated from
`Abdur-Rahman bin Ghanm
Al-Ash`ari that he said,
"I recorded for `Umar
bin Al-Khattab, may
Allah be pleased with
him, the terms of the
treaty of peace he
conducted with the
Christians of Ash-Sham:
`In the Name of Allah,
Most Gracious, Most
Merciful. This is a
document to the servant
of Allah `Umar, the
Leader of the faithful,
from the Christians of
such and such city. When
you (Muslims) came to us
we requested safety for
ourselves, children,
property and followers
of our religion. We made
a condition on ourselves
that we will neither
erect in our areas a
monastery, church, or a
sanctuary for a monk,
nor restore any place of
worship that needs
restoration nor use any
of them for the purpose
of enmity against
Muslims. We will not
prevent any Muslim from
resting in our churches
whether they come by day
or night, and we will
open the doors [of our
houses of worship] for
the wayfarer and
passerby. Those Muslims
who come as guests, will
enjoy boarding and food
for three days. We will
not allow a spy against
Muslims into our
churches and homes or
hide deceit [or
betrayal] against
Muslims. We will not
teach our children the
Qur'an, publicize
practices of Shirk,
invite anyone to Shirk
or prevent any of our
fellows from embracing
Islam, if they choose to
do so. We will respect
Muslims, move from the
places we sit in if they
choose to sit in them.
We will not imitate
their clothing, caps,
turbans, sandals,
hairstyles, speech,
nicknames and title
names, or ride on
saddles, hang swords on
the shoulders, collect
weapons of any kind or
carry these weapons. We
will not encrypt our
stamps in Arabic, or
sell liquor. We will
have the front of our
hair cut, wear our
customary clothes
wherever we are, wear
belts around our waist,
refrain from erecting
crosses on the outside
of our churches and
demonstrating them and
our books in public in
Muslim fairways and
markets. We will not
sound the bells in our
churches, except
discretely, or raise our
voices while reciting
our holy books inside
our churches in the
presence of Muslims, nor
raise our voices [with
prayer] at our funerals,
or light torches in
funeral processions in
the fairways of Muslims,
or their markets. We
will not bury our dead
next to Muslim dead, or
buy servants who were
captured by Muslims. We
will be guides for
Muslims and refrain from
breaching their privacy
in their homes.' When I
gave this document to
`Umar, he added to it,
`We will not beat any
Muslim. These are the
conditions that we set
against ourselves and
followers of our
religion in return for
safety and protection.
If we break any of these
promises that we set for
your benefit against
ourselves, then our
Dhimmah (promise of
protection) is broken
and you are allowed to
do with us what you are
allowed of people of
defiance and
rebellion.'''
(30. And the Jews
say: "Uzayr (Ezra) is
the son of Allah,'' and
the Christians say: "The
Messiah is the son of
Allah.'' That is their
saying with their
mouths, resembling the
saying of those who
disbelieved aforetime.
May Allah fight them,
how they are deluded
away from the truth!)
(31. They (Jews and
Christians) took their
rabbis and their monks
to be their lords
besides Allah, and (they
also took as their Lord)
the Messiah, son of
Maryam, while they were
commanded to worship
none but One God, none
has the right to be
worshipped but He.
Praise and hallowed be
He above what they
associate (with Him).'')
Lately I have
been seeing some
confusion on this
issue. Why should we
fight jihad? Some
people think that it
is best just to make
da'wa, or they think
that now is not the
time for jihad. Some
people seem to
simply think that
all violence is
wrong, and that
"Islam means peace,"
is some sort of
daleel for not
fighting jihad. Some
people think that
the conditions are
not present for
jihad. Some people
think that they will
be rewarded more for
being a student of
knowledge. Some
people think that,
while jihad is good
and everything, they
are not needed right
now. Some people
think that earning a
degree is more
important. Some
people think that if
they go they might
die (Oh really?).
Some people think
their families will
suffer. Some people
think that they need
permission from
their parents,
shuyookh, or those
whom they are
indebted to.
In sha'a Allah I
am going to show you
how these doubts and
reservations are
completely invalid
in the following
article.
We see from this
post that the
conditions of jihad
are met in many
situations. We also
see that one does
not need the
permission of the
parents or the
loan-giver in
defensive jihad. We
also see that asking
a scholar is not a
condition under any
circumstances.
However, for
those who are in a
lazy mood the
conditions of Jihad
ad-Daf' are as
follows: The enemy
is either preparing
to enter the Muslim
lands, or the enemy
has already entered
them. So you see
that the
"conditions" are in
reality the
"condition." Now for
it to be accepted
you have to have
Imaan and good
intentions. So,
while this might
offend some in CAIR
and ISNA and perhaps
a Syrian Mufti or
two, Christians,
Jews, and Hindus
there is no jihad
for you.
(Subhaan-Allah that
sentence is
accidental poetry).
There are
different conditions
for Jihad at-Talab,
but with all of the
Jihad ad-Daf' to go
around, we find that
for the purpose of
brevity, there is no
reason to go into
that. The link above
covers most of it.
Furthermore, we
learn that after
being a Muslim,
there is nothing
more obligatory than
than jihad as Ibn
Taymiyyah said:
Ibn Taymiyyah,
raheemahumaallah,
said, “So
attacking the enemy
who corrupts the
Religion and the
Dunya – nothing is
more obligatory
after faith than
repelling him, and
no conditions are
set for him, rather
he is repelled
according to the
capacity."
This means that
there are no extra
conditions for Jihad
ad-Daf' (defensive
fighting).
Furthermore, Ibn
Hazm said:
“And there is
no greater sin after
disbelief than the
prohibition of Jihad
against disbelievers
and giving them the
Muslims’ women…”

ON A WARM,
cloudy day in
the fall of
1999, the town
of Daphne, Ala.,
stirred to life.
The high-school
band came
pounding down
Main Street,
past the post
office and the
library and
Christ the King
Church.
Trumpeters in
gold-tasseled
coats tipped
their horns to
the sky,
heralding the
arrival of
teenage
demigods. The
star quarterback
and his
teammates came
first in the
parade, followed
by the
homecoming queen
and her court.
Behind them, on
a float bearing
leaders of the
student
government, a
giddy mop-haired
kid tossed candy
to the crowd.
Omar Hammami
had every right
to flash his
magnetic smile.
He had just been
elected
president of his
sophomore class.
He was dating a
luminous blonde,
one of the most
sought-after
girls in school.
He was a star in
the
gifted-student
program, with
visions of
becoming a
surgeon. For a
15-year-old, he
had remarkable
charisma.
Despite the
name he acquired
from his father,
an immigrant
from Syria,
Hammami was
every bit as
Alabaman as his
mother, a warm,
plain-spoken
woman who
sprinkles her
conversation
with
blandishments
like “sugar” and
“darlin’.”
Brought up a
Southern
Baptist, Omar
went to Bible
camp as a boy
and sang “Away
in a Manger” on
Christmas Eve.
As a teenager,
his passions
veered between
Shakespeare and Kurt
Cobain,
soccer and
Nintendo. In the
thick of his
adolescence, he
was fearless,
raucously funny,
rebellious,
contrarian. “It
felt cool just
to be with him,”
his best friend
at the time,
Trey Gunter,
said recently.
“You knew he was
going to be a
leader.”
A decade
later, Hammami
has fulfilled
that promise in
the most
unimaginable
way. Some 8,500
miles from
Alabama, on the
eastern edge of
Africa, he has
become a key
figure in one of
the world’s most
ruthless
Islamist
insurgencies.
That guerrilla
army, known as
the Shabab,
is fighting to
overthrow the
fragile
American-backed
Somali
government. The
rebels are known
for beheading
political
enemies,
chopping off the
hands of thieves
and stoning
women accused of
adultery. With
help from Al
Qaeda, they
have managed to
turn Somalia
into an ever
more popular
destination for
jihadis from
around the
world.

1. Brother,
what can you
tells us
about the
Obama's
State of the
Union
Speech?
2. My follow
up question
to that is
that. Can Obama
offer a
hopeful
economic
vision?
3. What are
your
thoughts
regarding
the 2nd term
of Ben
Bernanke
as Federal
Reserve
chairman?
4. Shaikh
Usama
released a
very brief
message to
Obama this
week and
advised that
there would
be no peace
with America
until Israel
was not
aided by the
U.S. in
their
oppression
of the
Palestinians?
Can you
comment on
this?
5. Moving onto
the legal
system, some
very important
legal events
have taken place
over the past
several weeks.
Let’s start with
one case here in
New York City,
what can you
tell us about
the trial of
sister Aafia
Siddiqui?
6 And finally
legally, what
are your
thoughts on the
recent ban on
Islam4uk and ALM
freedom of
speech in UK and
do you think
that we could
see this in
America as well
in near future?
7. Finally, due
to time, what do
you think about
the response of
United States
toward the
Haiti earthquake
and also about
US sending
11000+ troop
into Haiti for
so called peace
keeping?

"Machoism," and
Profit: Obama the
War President

Myriam
Miedzian
In 2009, an
Afghan-American
defense
contractor,
Hamed Wardak,
hired Patton
Boggs, a blue
chip lobbying
firm to push for
an extended U.S.
presence in
Afghanistan. The
lobbying firm in
turn set up a
nonprofit front
group -- the
Campaign for a
U.S. Afghanistan
Partnership --
on Wardak's
behalf to act as
the "face" of a
campaign for
increased U.S.
engagement in
Afghanistan.
Here we go
again! In late
2002, The
Committee for
the Liberation
of Iraq (CLI)
was set up by
Bruce Jackson, a
former Lockheed
Martin vice
president. And
we all know what
happened in
March 2003.
The role
that weapons
manufacturers
and others who
stand to profit
from wars play
in fostering
unnecessary wars
-- by fomenting
war scares,
libeling those
who are anti-war
as unpatriotic,
bribing
government
officials both
illegally and
legally via
campaign
contributions,
influencing much
of the media
etc. -- has been
widely
documented and
reported by H.C.
Englebrecht,
author of the
aptly titled Merchants
of Death,
Norman Cousins,
author of The
Pathology of
Power, and
many others.
Our long
standing
tradition of
viewing support
for war as
patriotic and
opposition as
unpatriotic
plays right into
the hands of the
people who stand
to make money
from those wars,
and leads much
of the media to
applaud wars,
however
unnecessary, and
to condemn those
who are against
them. Back in
the 19th
century,
Republican
Abraham Lincoln
was vilified as
a "moral
traitor" in the
Illinois press
because of his
opposition to
the
Mexican-American
war.
The other
ingredient in
the pro-war mix
is captured in a
recent New York
Times article
entitled: "The
Label Factor: Is
Obama a Wimp or
Warrior?" Helen
Cooper
writes,"Like
every Democratic
president since
John F. Kennedy,
President Obama
is battling the
perception that
he's a wimp on
national
security." In
what appears to
be an escalation
in macho
criteria, his
sending 30,000
more troops to
Afghanistan,
stepping up
drone strikes in
Pakistan, and
other
belligerent
measures, are
still not enough
to establish
Obama's macho
credentials. He
must also learn
to talk really
tough -- as in
stating that we
are at war with
terrorists --
and he must get
rapid results
for whatever
non-combative
steps he takes
with Iran,
Russia, North
Korea, or any
other nation
that we have
conflicts with.
As Cooper points
out, the concern
about Obama's
toughness is not
limited to
Republicans. For
example, Foreign
Policy magazine
recently had a
cover of Mr.
Obama next to
that "notorious
wimp" Jimmy
Carter with an
equal sign in
the middle.
Even though he
is Commander in
Chief, for a
president to not
follow the
orders of his
generals, to
resist military
action when they
call for it, to
fail to allocate
the funds they
request, is
probably the
most politically
high risk action
he can take, for
it leads to
accusations of
being unmanly,
wimpy, weak on
defense and
endangering our
national
security. The
implied lack of
patriotism is
intensified in
President
Obama's case
since 58% of
Republicans and
33% of all
Americans either
believe that he
is not a U.S.
citizen, or have
serious doubts.
And so, unlike
President
Kennedy who took
the risk of not
following the
numerous
military
officials and
cabinet members
who pressed for
an air assault
on Soviet
missile sites in
Cuba -- which
may well have
led to a nuclear
holocaust --.
President Obama,
has chosen to
follow military
advice on
Afghanistan.
By doing so,
he, plays right
into the hands
of Osama Bin
Laden who sees
the presence of
American
military forces
in Muslim
countries as
bleeding America
to the point of
bankruptcy
without
achieving any
positive
results.
According to his
"peacenik" son
Omar, Bin Laden
was thrilled
when George W.
Bush became
president.
Nothing like a
highly
belligerent
president to
humiliate and
enrage Muslims
by sending
Christians,
Jews, and women
to fight and
kill Muslims on
their own soil.
As Bin Laden
fully expected,
thanks to Dubya,
Al Qaeda
"franchises"
have sprung up
in numerous
countries on
several
continents.
The truth is
that we are not
at war. We are
trying to
prevent mostly
young male
terrorists --
who live in
countries which
include Yemen,
Nigeria,
Afghanistan,
Pakistan,
Germany, France,
England,
Holland, Canada,
the U.S. -- from
blowing us up or
gassing us.
There is no end
in sight as long
as macho talk,
posturing, and
action continue
to win over
thoughtful,
informed long
range defense
planning.
The combination
of mindless
"patriotism" and
"machoism"
goaded on by
financial
interests, comes
at a very high
human cost. In
his book about
the men who ran
the Vietnam war,
David Halberstam
informs us that
"the thing
Johnson feared
the most was...
that his manhood
was inadequate."
When a member of
his
administration
started to "go
soft"on the war,
Johnson
dismissed him
with , "hell he
has to squat to
piss." Result of
Johnson's need
to prove himself
macho:
approximately
60,000 Americans
and 2 million
Vietnamese
killed.
Dubya with his
"manly" swagger,
tough talk, and
extreme lack of
empathy, was the
very embodiment
of mindless
macho -- at
least when it
came to risking
the lives of
others. Result
of this tough
guy presidency:
so far
approximately
5,300 Americans
and according to
the very lowest
estimates,100,000
Iraqis have been
killed.
Approximately
two million
Iraqis have fled
the country.
The
macho-patriotism
intimidation
factor allows
the Pentagon to
enjoy enormous
and largely
unquestioned
budgets. The
revolving door
between the
military and
weapons
manufacturers
facilitates
pushing war in
order to make
big bucks.
Unlike
questioning
government
expenditures on
health,
education,
infrastructure,
the president
and members of
congress, as
well as the
mainstream
media, know that
seriously
questioning the
Pentagon budget
is tabu.
In 2008, an
internal audit
revealed that
Pentagon
expenditures
included close
to $15 billion
in Iraq war
goods and
services that
were unaccounted
for. Many
members of
congress
expressed their
intense shock
and dismay, but
this did not
stop them for
going on to vote
for increases in
military
spending. In his
State of the
Union speech,
President Obama
called for a
three year
freeze on many
domestic
programs. At the
same time he has
asked congress
for an extra $33
billion for the
Pentagon, to add
to the $708
billion budget
already approved
for next year.
Not to worry;
he'll get it.

President Obama,
Do You Know Your
Federal Courts Are
Not Open to the
Public?

This is an
article from
someone who has
been very active
in supporting Sister
Aafia. It is
true, anybody
that goes to the
trial now is
ID'ed and I
myself clashed
with the court
over this issue.
I am not so sure
Obama gives a
damn, but it
certainly does
suggest
an initiative that
will be
reproduced and
probably become
the norm. The
fascists are
coming and no
one cares.
People, it
really is time
to get up and
mobilize a
comprehensive
solution to our
issues.
Pakistan USA
Freedom Forum is
asking everyone
to support our
demand that Dr.
Aafia Siddiqui
receive a fair
trial, currently
under way in New
York's Federal
District Court,
500 Pearl St.,
Room 21B, before
Judge Richard
Berman. Never
before have
court officials
harassed
supporters by
taking names and
I.D. numbers
before they
entered a
courtroom. Such
intimidation
denies Dr. Aafia
a free, fair and
open trial. We
protest this
abuse.
On Thursday,
January 21, when
Shahid Comrade
went to enter
the courtroom of
Judge Berman,
the martial
asked him, as he
had asked
everyone else
entering that
courtroom, to
show him his ID
so he could
write down his
name and number.
Comrade refused,
and stated that
this was against
the Constitution
of the United
States. The
marshal stated
that this was
the order that
he had been
given by the
Chief Marshal.
Comrade found
noted
civil-rights
attorney Norman
Siegel, who was
in the court
building on
another matter
and told him
what had
happened.
Together, they
went to the
Chief Marshal of
the New York
Federal District
Court, on the
fourth floor of
500 Pearl St.
After the
Marshal asked
Comrade to
remain outside,
Siegel spoke to
the Chief
Marshal asking
him to rescind
the order. The
Chief Marshal
told Siegel he
would get back
to him. So far,
this order has
not been lifted.
Afterwards,
Siegel told
Comrade that, in
his 40 years as
a practicing
attorney, he has
never heard of a
trial in which
visitors were
told they had to
provide their
names and ID
numbers to get
into a trial,
and to his mind
this was
unconstitutional.
Pakistan USA
Freedom Forum
wishes to thank
Norman Siegel
for all his
assistance in
his defense of
civil rights and
the
Constitution.
Pakistan USA
Freedom Forum is
asking all
organizations
concerned with
human, civil and
constitutional
rights,
political
parties and
media to demand
fair and open
courts,
insisting that
Judge Berman
Federal District
Court halt this
intimidating
attempt to deny
justice to Dr.
Aafia Siddiqui.
We would
also like to
thank all those
who gave support
once they heard
that officials
were ignoring
the
Constitution. We
particularly
want to thank
Sara Flounders,
one of the
leaders of
Workers World
Party, and all
those who
attended her
talk last Friday
who stood up and
applauded the
immigrants and
Muslims who
stood up for the
cause of civil
rights in the
United States.
We will never
walk away from
sacrifices for
the cause of
humanity.
Pakistan USA
Freedom Forum
demands that
Judge Richard
Berman and the
Courts halt the
collection of
supporters'
names and I.D.
numbers,
publicly
identify why
this information
was collected,
whether this
information was
shared with any
other agencies
and destroy any
data collected
in the process.
An end to
this
intimidating
practice will
help ensure a
fair and open
trial for Dr.
Aafia Siddiqui
and all people
brought before
the court. We
ask President
Obama to send
the New York
Chief Marshal,
and all marshals
in the Federal
Courts, to a
refresher course
on the
Constitution of
the United
States.

It was a
good
conversation
although Mr.
Channer admitted
he has very
little tolerance
for the mention
of god and
religion, which
must of course
be our primary
axiomatic
foundation from
which we stem
the remainder of
a discussion on
economics and so
we clashed a
bit. It would
have been
wonderful if
there were more
time and we
spoke for
several hours
afterwards. Mr.
Channer is a
class act, a
positive man,
and open-minded
person. It is
hard in today's
world where the
West has really
put religion
aside as any
possible
solution and
avoids it like
the plague. I
think we set a
trend in giving
interviews and
never being
called back for
a second jaunt,
LOL! I will post
the entire video
with ending
after it is
released and it
will air on
television next
Thursday and we
hope to get some
dialougue with
the community
through it. It
takes a great
deal of fairness
to even host a
guest like me.
That in and of
itself is enough
to suggest that
we hold a great
deal of respect
for this man, so
please no
insulting and
harsh comments,
only words of
analysis or
questions for
elaboration. I,
on the other
hand, am open to
any and all
expletives. So,
feel free to
condemn.
Jazakallah
Khair!
