REQUEST INFORMATION: A police officer may approach, but not search a citizen in a public area for the purposeof requesting information, although there is no indication of criminal activity. INQUIRE: A police officer has a right to inquire of a citizen if they have reasonable suspicion that criminal activity istaking place. Reasonable suspicion permits a police officer to interfere with a citizen to the extent necessary to investigate. Without pro o f o f criminal activity o r probable caus e , a po lice o ffice r may no t forcibly s top, s earch and seize a citizen. People v. Hollman, 79 N.Y.2d 181, 581 N.Y.S.2d 619 (N.Y. Court of Appeals 1992). 3. FORCIBLY STOP: A police officer may forcibly stop a person in a public place and demand explanation of theperson’s conduct if police officer has reasonable suspicion that the person is committing, has committed, or isabout to commit a crime. If a police officer has properly stopped an individual, as a safety precaution they may frisk the individual for weapons. §140.50(1) New York State Criminal Procedure Law; Terry v. Ohio, 392 U.S. 1, 88 S.Ct. 1868 (1968). 4. DETAIN & ARREST: A police officer may detain and arrest a person when there is probable cause to doso. Upon arrest a police officer may thoroughly search a citizen. U.S.C.A. Const.Amend. 4. * D.
